Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the MySummitKeep platform and services (the “Service”). This AUP is incorporated into and forms part of the Terms of Service. Capitalized terms not defined here have the meanings ascribed to them in the Terms of Service.
1. General Conduct
You agree to use the Service responsibly and in accordance with all applicable laws, regulations, and Scouting America policies (as those policies may be amended from time to time). You shall not use the Service in any manner that:
- Violates any applicable local, state, national, or international law or regulation.
- Violates the rights of any individual, including privacy, publicity, intellectual property, or contractual rights.
- Is harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable.
- Exploits or harms minors in any way, including the collection of personal information from minors in violation of COPPA.
- Sends unsolicited or unauthorized advertising, spam, or bulk communications.
2. Prohibited Activities
2.1 Security Violations
- Probing, scanning, or testing the vulnerability of the Service.
- Breaching or circumventing security or authentication measures.
- Accessing data not intended for your use, or logging into an account you are not authorized to access.
- Interfering with availability (e.g., denial-of-service).
2.2 Data Misuse
- Collecting, harvesting, or assembling personally identifiable information of other users without consent.
- Using the Service to store or process data unrelated to Scouting America unit management.
- Sharing, selling, or distributing scout personal data, health records, or other sensitive information outside the Service’s intended functionality.
- Circumventing role-based access controls.
2.3 Content Violations
- Uploading or storing malware, viruses, worms, trojan horses, or any malicious code.
- Uploading content that infringes any copyright, trademark, trade secret, or other intellectual property right.
- Uploading or distributing any content that is illegal, including content depicting child sexual abuse or exploitation.
2.4 Service Integrity
- Reverse engineering, decompiling, disassembling, or otherwise deriving the source code or algorithms of the Service.
- Damaging, disabling, overburdening, or impairing the Service.
- Using automated scripts, bots, or other means to access the Service without prior written approval.
- Creating multiple accounts to circumvent account limits or restrictions.
3. Youth Protection
Because the Service supports youth-serving units, the following additional requirements apply:
- All users must comply with Scouting America’s Youth Protection Training requirements and policies, as those policies may be amended from time to time.
- The Service shall not be used to facilitate one-on-one private electronic communications between an adult leader and a youth member outside of approved program contexts (two-deep leadership rule).
- Users shall not upload or share inappropriate content involving minors.
- Parents and guardians must have access to view communications and records pertaining to their children, consistent with the Service’s role-based access controls.
- Users shall not use the Service to bypass any Scouting America barrier to communication, including but not limited to direct messaging functionality that has been disabled by the unit administrator.
4. CSAM and Mandatory Reporting
If we obtain actual knowledge of apparent child sexual abuse material (“CSAM”) on the Service, we will report it to the National Center for Missing & Exploited Children (“NCMEC”) CyberTipline as required by 18 U.S.C. § 2258A, preserve the material as required by 18 U.S.C. § 2258A(h), and cooperate with law enforcement.
If you become aware of CSAM or child exploitation on the Service, report it immediately:

- To law enforcement.
5. Enforcement
We reserve the right to investigate suspected violations. We may, in our sole discretion:
- Issue warnings for minor or first-time violations.
- Temporarily suspend access pending investigation.
- Permanently terminate accounts for serious or repeated violations.
- Report illegal activities to appropriate law enforcement authorities.
- Remove or disable access to any content that violates this AUP.
We will use reasonable efforts to notify you of enforcement actions, except where doing so would compromise an investigation or endanger any individual.
6. Appeals
If your account has been suspended or terminated and you believe the action was in error, you may submit an appeal to appeals@mysummitkeep.com within thirty (30) days. Appeals should include your account email, the action being appealed, and your basis for reinstatement. We will respond within ten (10) business days. Decisions on appeals are final, subject only to dispute resolution under the Terms of Service.
7. Reporting Violations
If you become aware of any violation of this AUP, report it to abuse@mysummitkeep.com. We take all reports seriously and will investigate promptly. For CSAM and child-exploitation reports, see Section 4.
8. Changes to This Policy
We reserve the right to modify this AUP at any time. Material changes will be communicated through the Service or by email at least thirty (30) days in advance. Continued use of the Service after the effective date of changes constitutes acceptance.
